Agreement to Terms

By accessing or using the services provided by brianlo.ai ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

Services Description

brianlo.ai provides AI automation consulting and implementation services for small businesses. Our services include:

  • Discovery and assessment consultations
  • Custom automation system design and implementation
  • Integration with third-party tools and platforms
  • Ongoing maintenance and support
  • Training and documentation

Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete information about your business needs
  • Grant necessary access to systems, tools, and platforms required for automation implementation
  • Respond to requests for information or approval in a timely manner
  • Ensure you have the authority to enter into this agreement on behalf of your business
  • Comply with all applicable laws and regulations in your use of our services

Payment Terms

Installation Services

One-time installation fees are due upon agreement to proceed with the project. We require a 50% deposit before work begins, with the remaining balance due upon completion.

Maintenance Services

Monthly maintenance fees are billed at the beginning of each billing cycle. You may cancel maintenance services with 30 days written notice.

Late Payments

Late payments may result in suspension of services. We reserve the right to charge interest on overdue amounts at a rate of 1.5% per month.

Intellectual Property

Our Property

All methodologies, frameworks, templates, and proprietary tools used in delivering our services remain the intellectual property of brianlo.ai.

Your Property

You retain ownership of your business data, content, and any pre-existing intellectual property. Custom automations built specifically for your business become your property upon full payment.

Confidentiality

We treat all client information as confidential. We will not disclose your business information, processes, or data to third parties without your consent, except as required by law or as necessary to provide our services.

With your permission, we may use general project descriptions and results (without sensitive details) as case studies or testimonials.

Warranties and Disclaimers

Service Warranty

We warrant that our services will be performed in a professional and workmanlike manner. If any deliverable does not meet the agreed specifications, we will correct it at no additional cost within 30 days of notification.

Disclaimer

EXCEPT AS EXPRESSLY SET FORTH HEREIN, OUR SERVICES ARE PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DO NOT GUARANTEE SPECIFIC BUSINESS RESULTS, REVENUE INCREASES, OR TIME SAVINGS. Results may vary based on your business circumstances, implementation, and other factors outside our control.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRIANLO.AI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

Our total liability for any claims arising under these terms shall not exceed the total amount paid by you for services in the twelve (12) months preceding the claim.

Third-Party Services

Our automations may integrate with third-party services (e.g., Zapier, Make, CRM systems, email providers). We are not responsible for the availability, functionality, or terms of these third-party services. You are responsible for maintaining your own accounts and subscriptions with these providers.

Termination

Either party may terminate the service agreement:

  • With 30 days written notice for ongoing maintenance services
  • Immediately for material breach that is not cured within 14 days of written notice
  • Immediately for non-payment of fees

Upon termination, we will provide you with all completed work and documentation. Any outstanding fees remain due.

Refund Policy

If you are not satisfied with our services, please contact us within 30 days of project completion. We will work with you to address any concerns. Refunds are evaluated on a case-by-case basis and may be provided at our discretion for work that does not meet agreed specifications.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts located in Santa Barbara County, California.

Changes to Terms

We reserve the right to modify these terms at any time. We will provide notice of material changes by posting the updated terms on our website. Your continued use of our services after such changes constitutes acceptance of the new terms.
